Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and aerotriproae Ltd ("Company", "we", "our", or "us"), a limited company incorporated in Malta with registration number C36251. By accessing or using our website at aerotriproae.pro or our beauty salon analytics platform services, you acknowledge that you have read, understood, and agree to be bound by these Terms.

Description of Services

aerotriproae provides beauty salon revenue optimisation analytics platforms and related services. Our services include but are not limited to data analytics, performance monitoring, customer insights, and business intelligence tools specifically designed for beauty salons and spa businesses.

User Obligations

As a user of our services, you agree to:

  • Provide accurate and complete information when creating an account
  • Maintain the confidentiality of your account credentials
  • Use our services only for lawful purposes and in accordance with these Terms
  • Not attempt to gain unauthorised access to our systems or other users' accounts
  • Not interfere with or disrupt the operation of our services
  • Comply with all applicable laws and regulations in your use of our services
  • Notify us immediately of any unauthorised use of your account

Account Registration and Security

To access certain features of our services, you may be required to register for an account. You are responsible for maintaining the security of your account and for all activities that occur under your account. You agree to immediately notify aerotriproae of any unauthorised use of your account or any other breach of security.

Payment Terms

If you subscribe to our paid services, you agree to pay all fees and charges incurred in connection with your account. All fees are quoted in Euros (EUR) and are non-refundable unless otherwise specified. We reserve the right to change our pricing with thirty (30) days' notice to existing subscribers.

Data and Privacy

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our services, you consent to the collection and use of your information as described in our Privacy Policy.

Intellectual Property

The aerotriproae platform, including all software, content, trademarks, service marks, trade names, logos, and other intellectual property, is owned by aerotriproae or its licensors and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use our services for your internal business purposes only. You may not copy, modify, distribute, sell, or lease any part of our services or included software, nor may you reverse engineer or attempt to extract the source code of that software.

Service Availability

We strive to maintain high availability of our services, but we do not guarantee uninterrupted or error-free operation. Our services may be subject to limitations, delays, and other problems inherent in the use of the internet and electronic communications. We reserve the right to modify, suspend, or discontinue any aspect of our services at any time.

Limitation of Liability

To the maximum extent permitted by applicable law, aerotriproae shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of our services. Our total liability to you for all claims arising from or related to these Terms or our services shall not exceed the amount paid by you to aerotriproae in the twelve (12) months preceding the claim.

Indemnification

You agree to defend, indemnify, and hold harmless aerotriproae and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney's fees) arising from your use of our services, your violation of these Terms, or your violation of any third-party rights.

Termination

Either party may terminate these Terms at any time with or without cause. Upon termination, your right to use our services will cease immediately. We may terminate or suspend your account and access to our services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, all provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Malta, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts of Malta, and the parties hereby consent to personal jurisdiction and venue therein.

Dispute Resolution

Any disputes arising from or relating to these Terms or our services shall first be addressed through good faith negotiations. If such negotiations fail to resolve the dispute within thirty (30) days, the dispute may be submitted to binding arbitration in accordance with the rules of the Malta Arbitration Centre.

Modifications to Terms

We reserve the right to modify these Terms at any time. If we make material changes to these Terms, we will notify you by email or by posting a notice on our website. Your continued use of our services after such notification constitutes acceptance of the modified Terms.

Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced by a valid provision that most closely approximates the intent and economic effect of the invalid provision.

Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published by us on our website, constitute the entire agreement between you and aerotriproae concerning our services and supersede all prior or contemporaneous communications and proposals between you and us.
